These Terms of Service ("Terms") govern your use of the Marin Tech Hospital website and the services we provide. By using our website or engaging our services, you agree to these Terms. If you do not agree, please do not use our website or services.
Our services
Marin Tech Hospital provides practical privacy services (such as digital footprint cleanup, data-broker and people-search removal assistance, account and privacy-settings reviews, password organization, and scam-prevention guidance) and technical support (such as device troubleshooting, setup, Wi-Fi and network help, account recovery, and small-business support). We tailor our work to each client and agree on the scope with you before starting.
Important disclaimers
- No guaranteed removal. We help reduce your online exposure, but no one can guarantee complete or permanent removal of information from the internet. Data brokers can re-list information over time, and some sources are outside our control.
- Not legal advice. We are not a law firm and do not provide legal advice. If your situation requires legal counsel, we will encourage you to consult a qualified attorney.
- Not a security guarantee. We help improve everyday security and reduce risk, but we are not a security auditor and cannot guarantee any specific security outcome or that a device, account, or system will be free from compromise.
- Best-effort support. Technical results can depend on hardware, software, and third-party services we do not control.
Fees and payment
Our standard rate is $110 per hour with a one-hour minimum. Flat-rate pricing may be agreed for specific projects. We will agree on the scope and an estimated cost before beginning work. Any third-party tools or subscriptions you choose to use (for example, automated data-removal services) are billed to you separately, at cost, and remain your responsibility to maintain. Payment is due as agreed at the time of service unless we arrange otherwise in writing.
Scheduling and cancellations
Please give us reasonable notice if you need to reschedule or cancel an appointment. We may charge for time reserved if you cancel on short notice or miss a scheduled visit, as agreed in advance.
Your responsibilities
- Provide accurate information and timely access to the devices, accounts, or systems you ask us to help with.
- Confirm that you own, or are authorized to request work on, any device, account, or information involved.
- Maintain your own backups of important data; while we take care, you are responsible for your data.
- Keep your passwords and recovery methods secure after our work is complete.
Third-party services
We may recommend or help you set up third-party tools and services. Those services are governed by their own terms and privacy policies, and we are not responsible for their performance, availability, pricing, or practices.
Privacy
Our handling of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
Disclaimer of warranties
Our services and this website are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except for those warranties that cannot be excluded or limited under applicable law.
Limitation of liability
To the fullest extent permitted by law, Marin Tech Hospital and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost data, profits, or revenue, arising out of or relating to our services or your use of this website. Our total liability for any claim will not exceed the amount you paid us for the specific service that gave rise to the claim. Nothing in these Terms limits liability that cannot be limited under California law.
Indemnification
You agree to indemnify and hold harmless Marin Tech Hospital and its owner from claims, damages, and expenses arising out of your misuse of our services, your violation of these Terms, or your violation of any law or third-party right.
Resolving disputes
If a concern comes up, we ask that you contact us first at marintechhospital@protonmail.com so we can try to resolve it directly. Most issues can be settled quickly and informally.
Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute that is not resolved informally will be handled in the state or federal courts located in Marin County, California, and you agree to that venue.
General
If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a transfer of our business. These Terms, together with our Privacy Policy and any written agreement we make with you for specific work, are the entire agreement between us regarding our services.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of our website or services after changes take effect means you accept the updated Terms.
